🔒 Privacy Policy – Eren’s Swim School

This Privacy Policy ("Policy") outlines the collection, use, disclosure, retention, and protection of personal information by Eren’s Swim School, a program operated under Lifeguardix Inc. (“we,” “us,” or “our”), in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation. By enrolling in our programs or using our services, including online scheduling or payment through third-party providers, you (“the user,” “client,” or “participant”) consent to all terms set forth in this Policy.

All registration and scheduling services are processed through Acuity Scheduling, a third-party service platform. All payment transactions are processed by Acuity’s integrated third-party payment processors (e.g., Stripe, PayPal, Square). Eren’s Swim School does not receive or store full credit card information. Access to payment information is restricted to encrypted tokens made available through Acuity’s platform and its respective processor solely for the purpose of initiating authorized transactions as described herein.

By submitting your registration or engaging in a transaction with Eren’s Swim School through Acuity Scheduling, you expressly authorize Eren’s Swim School and/or Lifeguardix Inc. to initiate charges to your stored payment method solely for services directly related to your enrollment, including but not limited to: swim lesson tuition, administrative fees, fouling penalties, material fees, private lesson upgrades, or other explicitly selected services related to program participation. You acknowledge and agree that no charges will be made for third-party, unrelated, or external goods or services, and that you remain solely responsible for managing your own payment credentials within the Acuity platform.

We collect only the personal information necessary for program delivery, safety, legal compliance, and communication. This includes, but is not limited to: legal name of participant and guardian, contact information, emergency contact details, swim level or age, medical disclosures, billing data, and registration history. This information is collected solely for internal use and is not disclosed to third parties except as required by law, necessary for payment processing, or essential to delivering program services.

You consent to the use of this data for administrative communication, scheduling notices, safety alerts, and legal compliance. You understand and agree that we may retain your data for the duration of program involvement and as otherwise required under federal or provincial data retention standards. Upon written request, you may access, modify, or request deletion of your personal data, unless such deletion would interfere with our ability to comply with legal, financial, or insurance obligations.

While we implement reasonable security measures to protect all stored data, including role-restricted access, encrypted platforms, and secure transfer protocols, you acknowledge that no method of transmission or storage is entirely risk-free. You agree not to hold Eren’s Swim School, Lifeguardix Inc., or any of its employees, contractors, agents, instructors, or platform providers liable for any data breach, theft, corruption, system compromise, or unauthorized third-party access beyond our control.

By submitting your information electronically, you agree to the full legal validity of this Policy and authorize Eren’s Swim School to collect, store, and use your information in accordance with its contents. You also acknowledge that submission of your registration, whether electronic or physical, constitutes full consent and legal agreement.

This Policy is governed by the laws of the Province of Ontario and applicable Canadian federal law. Any disputes arising from the interpretation, enforcement, or violation of this Policy shall fall under the exclusive jurisdiction of the courts of Ontario. If any provision of this Policy is found to be unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
